The two plaintiffs identified as both Prince Adebiyi and Prince Modile are both from the Akinsemoyin ruling house, and claim that they were chosen by the family to contest the title, after the passing onto the glory of the late Oba of Lagos identified as Oba Adeyinka Oyekan, the 2nd.

According to the 2 plaintiffs, they made it clear that he has no rightful claim to the throne but Oba Akiolu says he was rightfully chosen by the kingmakers known as the Alaafin, which led to his coronation on May 23, 2003.
